Oil and gas activities require a permit when disturbing an area 5 acres or more.

A person proposing oil and gas activities that involve 5 acres or more of earth disturbance over the life of the project shall obtain an Erosion and Sediment Control General Permit (ESCGP) under Chapter 102 prior to commencing the earth disturbance activities.
